Law 49/2018, of August 14, created the Portuguese legal regime of the assisted decision-making (capacity), thus eliminating the legal institutes of interdiction and disqualification, provided for in the Civil Code (CC). The aim of this legal regime was to embed a new vision of disability based on a model of rights, that grants people with disabilities an independent and autonomous life and reflects the acceptance of the International Convention on the Rights of Persons with Disabilities (CRPD) guidelines. This study aimed to understand the expressions of fear in the journeys of health professionals who worked in the confrontation of coronavirus disease 2019 (COVID‐19), in the city of Manaus, in the Brazilian Western Amazon. This is an exploratory qualitative study that adopts interpretive description as a method to generate informed knowledge responsive to the needs of the practice. We included 56 participants, comprising 23 health managers and 33 health workers (middle and higher level) of different professional categories. The results (...) revealed three circles of experience: (1) knowledge and professional experience in dealing with the disease (unknown–known–experienced); (2) the growing proximity to death and loss (predicted–witnessed–suffered); and (3) the involvement and proximity to whatever affects the individual, their emotions, and personal transformations in the face of the threat (the collective, the neighbor, and oneself). Our results suggest that health professionals who worked during the COVID‐19 pandemic in Manaus experienced insecurity, dread, and fear, illustrating the complexity of developing their activities in the front line of care and management during the different phases of the pandemic. A contribution of the study is precisely that of capturing this complexity, which suggests the impossibility of analyzing fear only in its simple manifestation, or in each circle of experience. The “new” paradigm proposed by Shanker & King is neither new nor a significant advance in our understanding of communication. Although we agree that social interaction is important, ignoring the roles of mental processes and the significance of information exchange is theoretically dangerous. Moreover, the “communicative dance” is sequential. If one partner does not lead, how is the other to follow?

This study aimed to analyze the explanatory contribution of social responsibility and organizational justice on commitment through the setting up of a theoretical model in order to better understand the relationships that are established between these constructs. The empirical study was developed in a public higher education institution with a sample of 233 employees, professors and staff. The proposed model was estimated using a structural equation model. It was possible to observe a relationship between interactional justice perceptions and social responsibility (...) and there contribute to the explanation of organizational affective commitment. The multiple tensions of the present time reverberate on identity compositions, translating norms endorsed in the games of economic globalization which stress coexistence, producing inclusion and exclusion at the same time. This context refers to the action of two antagonistic forces, the first being mixophobia, strongly disruptive and excluding, the second, on the other hand, moves towards inclusion, towards respect for otherness, acceptance of the other who is identified as mixophilia. Therefore, thinking about hospitality in the contemporary context leads us (...) to the analysis of the tensioning of assumptions, values ​​and models which normalize some identities and exclude others. The methodological course of reflection referenced in the arguments of Zygmunt Bauman’s thought gathers data from documentary research on political mobility guidelines, as well as data from a bibliographic review study on hospitality in education. The results demonstrate the urgency of strengthening studies on the construction of a culture of hospitality for different identities, via intercultural education. (shrink)

O espaço geográfico é uma categoria da ciência geográfica que possibilita uma acentuada e complexa possibilidade de refletir a coletividade social, sendo que neste desafio são trazidas à tona inúmeras perspectivas de análises da relação homem-natureza. Dessa feita, o presente estudo elabora uma breve discussão acerca do espaço geográfico enquanto uma ferramenta de análise das relações sociais, além de evidenciar a sua centralidade no interior da Geografia. Ao longo do estudo estão colocadas algumas concepções teóricas desta categoria geográfica, com destaque (...) para os entendimentos elaborados pela Geografia Crítica, uma reflexão que propõem a necessidade de se politizar os sujeitos por intermédio do ensino, com destaque para os conteúdos geográficos ensinados por seus respectivos professores desde os primeiros anos do ensino fundamental. A busca aqui foi a de confirmar a capacidade que a Geografia possui em se utilizar do próprio espaço geográfico na qual os alunos estão inseridos enquanto materialidade para uma concepção própria de mundo, sendo que através desta conquista, se permite compreender e pensar a construção de uma sociedade pela e para a própria coletividade envolvida. É esta a grande questão discorrida no presente ensaio, pensar uma proposta de ensino na geografia que politize os sujeitos, permitindo assim a formação de sujeitos ativos e cientes do seu papel no mundo. We aimed to characterize the age of onset of training, age at menarche, menstrual periodicity, and performance perception during the menstrual cycle and examined the impact of these reproductive variables on body composition, morphology, and body weight satisfaction in Brazilian elite futsal players. The study consisted of 115 female Brazilian elite futsal players from the top national teams. Data were collected during the twentieth Women’s Brazil Futsal Cup. Players were interviewed and self-reported their age of onset of training, age at (...) menarche, menstrual periodicity, and the menstrual period, where they performed best. We also asked for what they considered to be their ideal body weight as well as information related to their training. Subsequently, anthropometric measurements were performed to estimate the body composition and determine morphological characteristics. Fifty-nine players were postmenarche-trained and 52 were premenarche-trained. Eighteen, 65, and 28 were classified as early, normal, and late menarche, respectively. Only 11 and 1 had irregular menstrual cycles and were amenorrheic, respectively. Seventy-three, 23, and 9 reported that their game performance was the best at the follicular phase, menses, and luteal phase of the menstrual cycle, respectively. No associations between the four reproductive-related variables were found. Postmenarche-trained players had significant lower age at menarche and higher percentage body fat. The somatotype profile registered lower ectomorphy rate for the postmenarche-trained participants after controlling for covariates. Early menarche group presented higher sum of six skinfold thickness and endomorphy rate compared to normal and late menarche groups. No differences were found when menstrual periodicity groups and best performance groups were compared, except for higher femur width in the regular menstrual cycle group compared to the irregular one. The association between body weight satisfaction and the four reproductive-related variables were not observed. Premenarche-trained Brazilian elite futsal players had the menarche later than the postmenarche-trained athletes. Most of the participants had menarche age classified as “normal,” presented “regular” menstrual cycles and perceived to perform better during the follicular phase of the menstrual cycle. (shrink)

Trata-se da última dentre tantas reviravoltas em sua saudosa trajetória intelectual. Diante disso, discutimos aqui uma das principais contribuições para esse debate, presente Em um rabo de (...) foguete: trauma e cultura política em Ferreira Gullar, de Marcus Vinícius Furtado da Silva Oliveira. Neste livro, o autor procurou identificar e interpretar várias dessas reviravoltas presentes na vida intelectual do poeta e crítico literário maranhense. Notoriamente, algo que poderia enfraquecer o argumento de uma de suas teses centrais - no caso, o cancelamento das utopias em Ferreira Gullar – ao contrário, acabou por trazer ainda mais relevância para o trabalho, coincidentemente publicado no mesmo ano do texto de Gullar. O objetivo deste artigo é mostrar que o papel e o valor da ciência, em Bacon e em Espinosa, diferem segundo o papel e o valor que cada um deles atribui à metafísica como ramo do conhecimento. Em Bacon, o valor da ciência é grande na medida mesma em que o valor da metafísica é nenhum. Em Espinosa, esses valores se invertem. Mas enquanto a teoria do conhecimento em Bacon obedece a pressupostos teológicos, e portanto, em última instância, à fé, (...) em Espinosa o valor da metafísica e da ciência nasce das próprias concepções metafísicas, fruto de um trabalho de conhecimento que obedece, não à fé, mas ao próprio intelecto. O conceito de outrem (autrui) não recebeu a devida atenção no conjunto da filosofia de Deleuze até recentemente (VENTURA, 2020; FERREIRA, 2021). Outrem aparece na obra deleuziana em alguns momentos de Diferença e Repetição, em O que é a filosofia? – obra escrita juntamente a Félix Guattari – mas, sobretudo, num texto presente no apêndice de Lógica do sentido intitulado “Michel Tournier e o mundo sem outrem”, no qual ele comenta o romance de M. Tournier, Sexta-feira ou os limbos (...) do pacífico. Outrem nada mais é do que a expressão de um mundo possível, ou ainda, uma estrutura que organiza a percepção e assegura as margens e transições do mundo. Quando esta estrutura se dissolve, os simulacros ascendem às superfícies, destruindo as formas e libertando as forças e intensidades. Acreditamos que o agente dessa dissolução é Sexta-feira, cuja vinda desarranja a ordem forjada por Robinson em sua ilha. Sexta-feira já não funciona como a estrutura outrem, visto que ele é um outro de outrem, que vai possibilitar o acesso a um campo transcendental impessoal, pré-individual, povoado de singularidades livres. Os conceitos de Emmanuel Lévinas de “rosto” e “absolutamente outro” (tout autre) auxiliará nesse movimento a fim de compreender o outro de Deleuze, embora seja necessário apontar a sua pertinência e as suas limitações. In this chapter we use methods of corpus linguistics to investigate the ways in which mathematicians describe their work as explanatory in their research papers. We analyse use of the words explain/explanation (and various related words and expressions) in a large corpus of texts containing research papers in mathematics and in physical sciences, comparing this with their use in corpora of general, day-to-day English. We find that although mathematicians do use this family of words, such use is considerably less prevalent (...) in mathematics papers than in physics papers or in general English. Furthermore, we find that the proportion with which mathematicians use expressions related to ‘explaining why’ and ‘explaining how’ is significantly different to the equivalent proportion in physics and in general English. I suggest here ecologies of the nascent state, posing the following general questions: what is this state and what is it to live, to fabricate modes of life, in its immanence? I believe populating this state is, by right, ‘ecological’, even if what I offer here is only a sketch or glimpse, playful as it is, of the possibility of such modes of life, of dwelling. As I develop it here, the nascent is in flight of being. It is populated (...) by lesser, minoritarian existences. If it is ‘ecological’, it is because these existences, or modes of becoming, are themselves, in their own right, ‘ecologies’, that is, modes of dwelling, of life, on the ‘other side of existence’, as Antonin Artaud put it once, in exile from Being. The power to return eternally to the nascent state is the power to live, to dwell, in the absolute forgetfulness of Being, in the interstice where philosophy supposedly ends, but where it nevertheless begins again, in oblivion itself, where being is never already the verticality of Being, its difference with beings, but always nascent, in the beginning, eternally so. The purpose of this study was to identify the relative contribution of individual and contextual predictors to students’ attitudes toward the acceptability of cheating and plagiarism. A group of 324 students from a tertiary institution in New Zealand completed an online survey. The findings indicate that gender, justice sensitivity, and understanding of university policies regarding academic dishonesty were the key predictors of the students’ attitudes toward the acceptability of cheating and plagiarism, both as agents of dishonest conduct and as witnesses (...) of misconduct among their peers. The implications of these findings for the development of policies and initiatives in tertiary institutions are discussed. (shrink)

This study investigates whether employees attribute different motives to their organization's corporate social responsibility efforts and if these motives influence employee performance. Specifically, we investigate whether employees could distinguish between intrinsic and extrinsic CSR motives by surveying 229 employee–supervisor dyads from various industries , and the impact of these perceptions on in-role and extra-role performance of subordinates. We found that employee task performance increases when employees attribute both intrinsic and extrinsic motives for CSR. Moreover, when employees perceive that their organization (...) invests in a CSR practice that is both intrinsic and extrinsic, they also tend to exert extra effort in their work. Theoretical and practical implications are also discussed alongside future research directions. (shrink)

Microbiome research shows that human health is foundationally intertwined with the ecology of microbial communities living on and in our bodies. This challenges the categorical separation of organisms from environments that has been central to biomedicine, and questions the boundaries between them. Biomedicine is left with an empirical problem: how to understand causal pathways between host health, microbiota and environment? We propose a conceptual tool – environmentality – to think through this problem. Environmentality is the state or quality of being (...) an environment for something else in a particular context: a fully perspectival proposition. Its power lies partly in what Isabelle Stengers has called the efficacy of the word itself, contrasting the dominant sense of the word environment as something both external and fixed. Through three case studies, we argue that environmentality can help think about the causality of microbiota vis-a-vis host health in a processual, relational and situated manner, across scales and temporalities. We situate this intervention within historical trajectories of thought in biomedicine, focusing on the challenge microbiome research poses to an aperspectival body. We argue that addressing entanglements between microbial and human lives requires that the environment is brought into the clinic, thus shortening the conceptual gap between medicine and public health. Early embryogenesis is marked by a frail Spindle Assembly Checkpoint (SAC). The time of SAC acquisition varies depending on the species, cell size or a yet to be uncovered developmental timer. This means that for a specific number of divisions, biorientation of sister chromatids occurs unsupervised. When error‐prone segregation is an issue, an aneuploidy‐selective apoptosis system can come into play to eliminate chromosomally unbalanced cells resulting in healthy newborns. However, aneuploidy content can be too great to overcome, endangering viability.SAC generates (...) a diffusible signal to lengthen time spent in mitosis if needed, ensuring correct chromosome segregation, a fundamental factor in the generation of euploid cells. Thus, it remains puzzling what benefit could come from delaying SAC acquisition till later in the development. In this review, we describe what is known on SAC acquisition in distinct species and highlight pending research as well as potential applications for such knowledge. (shrink)

Irony is acknowledged to be usually critical: the ironic speaker tends to exhibit an apparent positive attitude in order to communicate a negative valuation. The reverse is considered to be also possible though: the ironic speaker can praise by apparent blaming, although it seldom happens. This unbalance between the two sorts of ironic examples is the so-called asymmetry issue of irony. Here I shall deny the possibility of being ironic without criticizing — hence the asymmetry issue is an illusion. Soren Kierkegaard's Works of Love, a series of deliberations on the commandment to love one's neighbor, has often been condemned by critics. Here, Ferreira seeks to rehabilitate Works of Love as one of Kierkegaard's most important works. He shows that Kierkegaard's deliberations on love are highly relevant to some important themes in contemporary ethics, including impartiality, duty, equality, mutuality, reciprocity, self-love, sympathy, and sacrifice. Ferreira also argues that Works of Love bears on issues peculiar to a religious ethic, (...) such as the role of God as "middle term," and the possibility of preserving the aesthetic dimensions of love in a religious ethic of relation. The present study aimed to explore and map the views of Portuguese laypersons regarding the acceptability of downsizing and restructuring measures during a recession. Two hundred and seven participants with various levels of training in economics were presented with a number of realistic scenarios depicting various measures, and were asked to indicate the extent to which they considered them to be acceptable. The scenarios were created by varying three factors likely to have an impact on people’s views: the magnitude of (...) a company’s reduction in net sales, the magnitude of planned downsizing, and the way in which downsizing would be implemented, either through layoffs, job alliances or both. Six qualitatively different personal positions were found. Four of these following positions were expected: never acceptable, mainly depends on the magnitude of downsizing, mainly acceptable and job alliance. Two unexpected positions were also observed: drastic measures and undetermined. (shrink)

The increasing use of digital technologies in judicial and arbitration proceedings increases the usage of digital evidence by the parties, which brings the necessity of creating patterns for adjudicators to admit and assess this new type of evidence. This paper generally addresses digital evidence focusing on the second moment in international arbitration proceedings. It also narrows the topic to hacked and leaked evidence and its admissibility in international arbitration. The literature review showed a significant amount of research devoted to the (...) evidence in arbitration. Some considered electronic evidence within one jurisdiction; others focused on certain forms of digital evidence such as electronic signatures. Papers on digital evidence in international arbitration approach arbitration rules for digital evidence but skip admissibility issues. No systemic and complex works research digital evidence in arbitration, explicitly focusing on the admissibility of hacked and leaked digital evidence from a comparative perspective. Also, no research deals with enforcing international arbitration awards relying on illegally obtained digital evidence. In these cases, there could be a possible violation of domestic public policy under the New York Convention terms (art. V, 2, b). That is why the paper aims to offer the concept of digital evidence in international arbitration, including hacked and leaked evidence, criteria of its admissibility and relevance, and design the arbitration guidelines for assessing hacked and leaked evidence. Comparative legal analysis of the international arbitration rules and national procedure law allowed us to compare the regulatory approaches to the definition of digital evidence and its admissibility worldwide. The method of legal modeling allowed designing model guidelines for arbitral tribunals to evaluate the admissibility and relevance of digital evidence, including hacked and leaked evidence. Moreover, the case study method allowed us to analyze jurisprudence and define criteria for admission of hacked and leaked evidence. We conclude that the admissibility of hacked and leaked evidence depends solely on the arbitrator’s broad discretion to assess the evidence. Nevertheless, thorough evidence analysis and a well-reasoned award are always mandatory. (shrink)

Aristotle says that a fallacy of accident takes place whenever something is held to belong in the same way to an object and to its accident (SE 5 166b28-30). The Received View among interpreters takes “accident” (συμβεβηκός) in that connection to stand for any predicate that is not identical to its subject, and makes the fallacy consist in mistaking predication for identity. Such an analysis, however, gives “accident” a meaning otherwise unattested in the corpus; makes all cases of the fallacy (...) inconclusive, whereas inferences of the same kind are warranted (with a qualification) at different places in the corpus; does not cover cases which in Aristotle’s view fall under the fallacy of accident, for which a different analysis and solution must be provided; and does not square with Aristotle’s own solution in terms of sameness or difference in substance and being. This chapter presents a new take on the subject, grounded on Aristotle’s expressed views in the Sophistical Refutations and other works, according to which the fallacy takes place whenever a substitution of co-extensives, or even of necessary equivalents, makes reciprocation fail to (necessarily) hold between relata.
